1. Agreement to Terms

By accessing or using the KRFT mobile application and related services (“the Service”), you agree to be bound by these Terms of Service (“Terms”) and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use the Service. KRFT is operated by [Company legal name] (“KRFT,” “we,” “us,” or “our”). All materials within the app are protected by applicable copyright and trademark law.

2. Eligibility

You must be at least 20 years old to use the Service. By using the Service, you confirm that you meet this requirement. KRFT does not sell, serve, deliver, or supply alcohol. The Service provides information and discovery features only. All responsibility for alcohol consumption and compliance with applicable laws rests with the individual user and the venue.

We are not responsible for damages, injuries, losses, or disputes arising from your use of the Service or any third-party venue (including issues related to entry rules, pricing, offers, or availability).

3. Use Conditions

In order to use the Service, the user is required to download and install the Application. Users may view and use the content within the Service through the Application solely for personal and non-commercial purposes. All copyrights and other intellectual property rights related to the content included in the Service belong to KRFT, the Company, or the respective rights holders. This constitutes a license to use and does not imply any transfer of rights. Users shall not engage in the following acts (including using automated tools to access or scrape the Service):

• Modify or copy the content
• Use the content for any commercial purpose or public display
• Attempt to reverse engineer any software within the Service
• Remove any copyright or proprietary notices
• Transfer the content to another person or “mirror” it on another server

4. User Accounts

When you create an account, you agree to provide accurate and current information. You are responsible for maintaining the confidentiality of your account and password, and accept responsibility for all activities under your account. Notify us immediately if you suspect unauthorized use.

5. Content and Conduct

Our app allows venues and users to submit or update information, including venue details, tap lists/beer menus, availability notes, photos, ratings, and special time-limited offers or announcements known as “Flares.” Some venues may be KRFT partner venues, which may include richer venue pages, venue-managed tap lists, and in-venue QR scanning. KRFT may offer a rewards feature (“KRFT Points”) that lets users earn points by scanning QR codes at participating partner venues and/or completing other eligible actions described in the app. KRFT Points have no cash value, are not legal tender, are not transferable, and may be changed, suspended, or discontinued at any time. We may withhold, reverse, or cancel points if we reasonably suspect fraud or abuse. Partner venues may pay KRFT a performance-based fee related to Verified Visit scans. Users do not pay this fee. You are solely responsible for the legality, accuracy, and appropriateness of content you submit. By posting, you grant KRFT a worldwide, royalty-free, non-exclusive license to use, display, reproduce, distribute, and modify (for formatting and display) that content within the Service and related promotional materials. We may, without prior notice, remove or modify content that we believe violates these Terms, applicable laws, or the rights of others.

6. Accuracy of Information, Tap Lists & Flares

KRFT displays venue information and notifications (“Flares”) based on submissions from venues and users. Tap lists, availability, prices, and offers are time-sensitive and can change quickly. Even where partner venues update information directly, we do not guarantee that any tap list, Flare, deal, price, or operating schedule is currently active or correct at the time of your visit. Information is subject to change without notice. Venues are independent third parties. KRFT does not own, operate, or control the venues listed. We are not responsible for the quality, safety, legality, or availability of their products or services.

Please confirm critical details directly with venues before making plans. Where QR scanning is available, scans are intended to be completed inside the venue and by the user physically present (do not scan copied/screenshot codes).

7. Prohibited Uses

You agree not to use the Service:

• For unlawful purposes
• To infringe on others’ intellectual property rights
• To harass, abuse, or harm other users
• To submit false or misleading information or to manipulate scanning/KRFT Points (including scanning without being present, using copied/screenshot QR codes, location spoofing, or automation)
• To upload or transmit viruses or malicious code, or attempt unauthorized access to the Service

8. Suspension and Termination

We may suspend or terminate your account or access to the Service at any time, without prior notice, if you breach these Terms or engage in harmful behavior.

9. Intellectual Property

All content and materials available on the Service, including but not limited to the KRFT name, logo, design, software, and other features, are the property of KRFT and/or its licensors and are protected by applicable copyright, trademark, and intellectual property laws. You may not use, reproduce, or distribute any of these materials without our prior written permission.

10. Privacy

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your information. For clarity: we do not share your personal identity with bars or breweries. We may share aggregated, non-identifying trends and analytics. Some features may require device permissions (such as camera access for QR scanning and/or location access for “nearby” features). You can control permissions in your device settings, but some features may not function without them.

11. Disclaimer

The Service is provided “as is” and “as available.” KRFT makes no warranties regarding accuracy, reliability, or availability of the app or its contents. We do not guarantee uninterrupted or error-free operation.

12. Limitations

To the maximum extent permitted by law, the Company shall not be liable for any damages arising out of or in connection with the use of or inability to use the Service (including, without limitation, data loss, business interruption, or any indirect or consequential damages), except in cases where such damages result from the Company’s willful misconduct or gross negligence.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable under applicable law, the remaining provisions shall nonetheless continue in full force and effect.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be notified through the app or website. Continued use of the Service after such changes indicates acceptance of the revised Terms.
